1Who we are
Nepali Companion ("the app") is published by Ars Vitae Pty Ltd, an Australian company trading as Hex Pro ("we", "us", "our"). These terms are an agreement between you and Ars Vitae Pty Ltd about your use of the app.
2Agreeing to these terms
By installing or using the app you agree to these terms. If you do not agree, do not use the app.
3Licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to install and use the app on Apple devices you own or control, as permitted by the App Store terms. Apple's standard Licensed Application End User License Agreement also applies to the copy you download from the App Store.
The app is proprietary software. The app and its content, including the software, lessons, text, audio, and artwork, are owned by us or our licensors. No rights are granted beyond the licence in this section.
4Purchases
The app is free to download and includes the first three chapters. A single one-time in-app purchase unlocks the remaining chapters. The price is shown in the App Store before you confirm the purchase. The purchase is not a subscription and does not renew.
Payment is processed by Apple through your Apple Account. The purchase can be restored on any device signed in to the same Apple Account using the restore option in the app's settings.
Refund requests are handled by Apple under the App Store terms. Nothing in this section limits your rights under section 11.
5Trademarks, components, and links
The Hex Pro name, the app icon, the hexagon-split logo, and the name "Nepali Companion" are trademarks of Ars Vitae Pty Ltd. These terms grant no right to use them.
Third-party components bundled with the app are listed, with their licences, in the Third-party notices document in the app.
Banners and links in the app may open the App Store or an external website, which have their own terms and are not governed by these. Until the in-app purchase unlocks the full course, the home screen shows a banner for another Hex Pro app, and we may change or stop showing it at any time. The Hex Pro mark on the home screen opens our website.
6Educational content
The app is a self-study aid for the Devanagari script and Nepali vocabulary. The teaching material, including the synthesized pronunciation audio, may contain errors and simplifications. It is not professional advice. Do not rely on the app for legal, medical, official, safety-related, or professional translation purposes.
7Your data
Your progress, review schedule, and settings are stored only on your device. We hold no copy and cannot restore them. See the Privacy Policy.
8Acceptable use
The app is for your personal use. You must not copy, extract, redistribute, or resell the app or its content, circumvent the purchase requirement, or use the app or its content to build a competing product.
9Availability and changes
We may change, suspend, or discontinue the app or any part of it, and updates may add, change, or remove features and teaching material. Nothing in this section limits your rights under section 11.
10No warranty and liability
To the extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost data or lost progress, arising from your use of the app. Nothing in these terms excludes liability that cannot be excluded by law.
11Australian Consumer Law
If you are in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.
12Governing law
These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state, without affecting any right you have to bring proceedings where you live.
13Changes to these terms
If these terms change, the effective date above changes and the updated terms ship in the same app update. Continued use of the app after an update is acceptance of the updated terms.
